The Court held that where all documentary material is tendered by agreement at a reference hearing with submissions as to weight, a party cannot later complain of procedural unfairness about reliance on specific reports within that material, particularly where those reports were served years earlier and the party failed to seek cross-examination or rebuttal evidence. For s 57 ICA interest, the claim that ultimately succeeds must have been made in its totality and with adequate supporting information before interest begins to run.
