Non-service of the prosecution brief of evidence on an unrepresented defendant at least 14 days before a summary hearing, as required by s 183 of the Criminal Procedure Act 1986 (NSW), constitutes a denial of procedural fairness amounting to jurisdictional error warranting certiorari, even where the defendant did not raise the issue at the hearing due to misunderstanding the disclosure requirements.
