The Court sentenced the offender to 21 years' imprisonment (non-parole period of 15 years and 9 months) for the premeditated domestic violence murder of his intimate partner, after applying a 25% discount for an early guilty plea from a pre-discount sentence of 28 years. The Court rejected submissions that the offender's moral culpability was reduced by low intellectual capacity (finding the expert evidence insufficient given English as a second language and non-standard testing conditions) and declined to find Bugmy principles engaged where the offender's childhood exposure to domestic violence was limited and the offending was planned rather than impulsive. The Court also declined to find special circumstances to vary the statutory ratio, noting the offender's likely deportation as a non-citizen could not be used to adjust the non-parole period per Maxwell v R [2020] NSWCCA 94.
