The Court granted leave to withdraw admissions in a defence under UCPR r 12.6, accepting the defendant's explanation that he had erroneously admitted the authenticity of bank document signatures which he later concluded were not his, following investigations prompted by documents produced on subpoena. Leave was granted on terms including costs, and the Court noted the plaintiff would remain free to cross-examine the defendant at trial about the circumstances in which the admissions were made and withdrawn.
