Where a director gives an undertaking to the court to meet any adverse costs order against a corporate plaintiff in order to avoid an order for security for costs, and the plaintiff is subsequently wound up, the court will make a non-party costs order against the director on the basis that it would be unjust for the defendant to be limited to the insolvent company's assets.
