The Court made no order as to costs in three proceedings where creditors' statutory demands had been set aside by consent, holding that DJ&A's submissions assumed but did not establish that the disputes it raised were genuine in the relevant sense, and that without a determination on the merits the Court could not be satisfied it was unreasonable for the Youshare Companies to have issued the demands. The Court also indicated it would likely have declined to quantify costs on a lump sum basis given complex questions about entitlement to recover the same costs amount across three overlapping proceedings.
