Under s 65(1)(c) of the Succession Act 2006 (NSW), allocation of burden of a family provision order is an evaluative decision on all material facts including s 60(2) factors without presumed prioritisation of any consideration, and the burden jurisdiction cannot be exercised to produce a per stirpes distribution equalising family branches.
