The Court granted leave nunc pro tunc under ss 4 and 5 of the Felons (Civil Proceedings) Act 1981 (NSW) for a plaintiff in custody to commence and maintain proceedings alleging childhood sexual abuse at a public school. The Court applied the established low threshold test, being satisfied that the claim was not an abuse of process and had a prima facie ground, based on the solicitor's assessment of reasonable prospects, a consistent history of abuse given to a psychiatrist, a plausible chain of causation to diagnosed psychiatric conditions, and the identification of the alleged perpetrator and approximate date of abuse.
