The Court sentenced the offender to an aggregate term of 22 years and 9 months (non-parole period of 16 years and 11 months) for the murder of his mother by setting her alight with petrol and assault occasioning actual bodily harm on a 16-year-old who intervened. The Court applied De La Rosa principles 1 and 2, finding that the offender's personality disorder, complex PTSD, and substance abuse disorder — born of childhood emotional and physical abuse — materially contributed to the offending and reduced moral culpability and the weight given to general deterrence, but did not reduce the weight given to specific deterrence. The Court treated the Bugmy factors as separate from and additional to the mental illness findings, giving full weight to the offender's deprived background, while declining to find provocation as a mitigating factor on the basis that the deceased's conduct did not go beyond relationship tension and general enmity.
