Where the index offences are of the gravest kind (double murder), even actuarial assessments placing the offender at average or below average risk of violent recidivism may be insufficient to displace a finding of unacceptable risk at the preliminary stage, particularly where there is a demonstrated nexus between substance abuse and the violent offending and a pattern of non-compliance with supervision conditions.
