The Court held that a psychologist's expert report prepared for a bail application must be given limited weight where the psychologist proposes to personally supervise or profit from the treatment plan recommended in the report, as this discloses a conflict of interest inconsistent with the paramount duty under Schedule 7 of the UCPR. However, the report was not entirely disregarded; the Court accepted that on a bail application, some weight should still be given to such a report given the practical and financial difficulties applicants face in obtaining psychiatric diagnoses, and that the rules of evidence do not bind the Court under s 31 of the Bail Act 2013. Bail was granted with stringent conditions but on terms that excluded the conflicted psychologist from any supervisory role in the treatment plan.
