In building contract disputes where the contract is terminated for the builder's breach, the proper measure of damages is the cost of reasonable and necessary work to make the building conform to the contract less the unpaid contract price, and where actual completion costs are known they ordinarily provide the basis for damages rather than theoretical costs. Admissions in affidavit evidence must be clear and unambiguous to be relied upon, and the assessment of quantum meruit claims is a question of fact not amenable to appeal on a question of law.
