The Court varied a standard costs order to an indemnity costs order from the date of an unaccepted offer of compromise, and fixed costs as a gross sum. A 'walk away' offer proposing judgment for the defendants with no order as to costs was held to contain a genuine element of compromise where the defendants offered to forgo approximately $66,691 in incurred costs. The plaintiff's submissions based on mental health, ignorance of court procedures, financial necessity, public interest, and personal hardship were all rejected as insufficient to displace the defendants' entitlement under UCPR r 42.15A.
