The Court sentenced Atteya to 34 years (NPP 25 years 6 months) and Khaled to 24 years (NPP 18 years) for the murder of Nazlioglu, declining the Crown's submission that a life sentence was warranted for Atteya. Applying s 61(1) of the Crimes (Sentencing Procedure) Act 1999 (NSW), the Court held that although Atteya's involvement in a meticulously planned killing partly for financial reward was of high seriousness, his culpability was not so extreme as to require a life sentence, particularly given his subordinate role to the absent co-offender Baltagi and his diagnosed mental health conditions. The Court rejected Atteya's claim of lasting cognitive impairment from a traumatic brain injury, finding on the totality of neuropsychological evidence that he had routinely overstated symptoms and deliberately performed poorly in testing, and assessed Khaled's offending as mid-range seriousness given his supportive but important logistical role, with his dissociative tendencies reducing moral culpability only slightly.
