Pursuing a claim founded on a fundamental error about the state of the pleadings, failing to adduce evidence of loss where no bifurcation order was made, and tendering multiple differently drafted and executed versions of the same documents without explanation may together constitute unreasonable or delinquent conduct warranting indemnity costs. Where multiple versions of key documents are tendered and no satisfactory explanation is given at a show cause hearing, the court may exercise its duty to refer the matter to the Attorney General for investigation of possible criminal offences.
