1To restrain property outside NSW in connection with 'external serious crime related activity', the applicant must establish that the person whose interests are affected is domiciled in NSW (s 10A(3)); mere residence is insufficient to prove domicile.
2Domicile of choice may be inferred from evidence such as electoral roll registration, registered addresses with Roads & Maritime Services, and correspondence from government agencies indicating NSW addresses, even without evidence of the person's place of birth.
3Involuntary detention in NSW (whether on remand or serving a sentence) cannot constitute NSW as a domicile of choice, as domicile of choice must be freely chosen.
