An owners corporation that is a successor in title to a developer is entitled to the benefit of statutory warranties under ss 18C and 18D of the Home Building Act 1989 (NSW) against both the builder and the developer, and where defendants fail to appear at trial, the court may proceed under UCPR r 29.7 provided the defendants have been served and afforded ample opportunity to be heard.
