Grounds of appeal from the Local Court that are styled as questions of law but are in substance directed to factual findings or credit assessments will not be treated as raising questions of law for the purposes of s 39 of the Local Court Act 2007 (NSW), and leave under s 40 will be refused where the grounds do not raise issues of principle, general importance, or reasonably clear injustice, particularly where costs are disproportionate to the amount in dispute.
