Continuing to act for a client on a claim that proves unwinnable does not, without more, constitute the egregious conduct required to engage the wasted costs jurisdiction under s 99 of the Civil Procedure Act 2005 (NSW) or the court's inherent jurisdiction; something additional in the nature of unreasonable conduct or conduct unconnected with success in the litigation must be demonstrated.
