An electronic signature on a loan acceptance form via DocuSign creates a binding contract incorporating the terms and schedule of the loan offer, even where the borrower did not separately sign the offer, schedule, or terms documents. A second application for summary judgment made without leave under r 294(2) UCPR is an irregularity under r 371(1), not a nullity, and remains valid and effectual unless the court orders otherwise.
