The applicant company succeeded in its claim against the respondent motor vehicle dealer, and the Tribunal ordered the respondent to pay $20,542 in repair costs within 30 days. The Tribunal found the used vehicle was not of acceptable quality under s 54 of the ACL at the time of supply, with multiple mechanical defects (split differential bush, oil leaks, worn brakes, blown speaker) and cosmetic defects (poor repaint, torn seat leather) present at delivery. The failures were characterised as non-major and remediable, entitling the consumer to recover reasonable repair costs under s 259(2)(b)(i) after the supplier failed to remedy within a reasonable time. Claims for the odometer discrepancy failed for want of valuation evidence establishing loss, and claims for legal costs were refused under the QCAT Act's presumption that parties bear their own costs absent special circumstances.
