The Court held that the defendants (Buyers) should pay the plaintiffs' (Sellers') costs of the account on the standard basis up to the date of a Calderbank offer (12 March 2025), but that the plaintiffs must pay the defendants' costs from that date on the indemnity basis because the rejection of the Calderbank offer was unreasonable and imprudent. The offer had allowed the Sellers the maximum amount recoverable on the account with no costs claim, representing a significant compromise. No further costs orders were made regarding the amended application or the 5 June application, the latter being governed by an existing consent order for 'costs in the proceeding'.
