The employer's s 81A referral was partially successful: weekly payments were ceased, and most Division 2 Part VI treatment benefits were stopped, but the employer was ordered to pay for pain psychology treatment from the date of the hearing. The Tribunal held that s 69(13) of the Workers Rehabilitation and Compensation Act 1988 (Tas) does not require the 'further certificate' to certify a period of incapacity — a certificate in the approved form relating only to treatment is sufficient to trigger the employer's right to dispute ongoing liability under s 81A. Where an employer's own independent medical evidence expressly states that a particular treatment 'is required for the injury', the employer cannot establish a reasonably arguable case to dispute liability for that specific treatment, even if the expert also opines that the worker has wholly or substantially recovered and that other treatment modalities are not indicated.
