The employer's s 81A referral succeeded: the Tribunal found jurisdiction existed under s 69(13) due to an 80-day gap in the provision of medical certificates to the employer, and ordered that weekly compensation payments and Division 2 benefits are not to be paid to the worker. The worker's provision of certificates to the insurer rather than the employer did not satisfy s 69(13), which requires certificates to be provided to and received by the employer; any departure from this requires clear and unambiguous authorisation and agreement of all parties, following Dale v Cigarette & Gift Warehouse (Franchising) Pty Ltd [2026] TASSC 5. The employer established a reasonably arguable case to dispute the claim on the basis that the worker's injury did not arise from employment to a substantial degree, or alternatively arose from reasonable administrative action taken in a reasonable manner, with the Tribunal confirming that questions of reasonableness of administrative action require findings of primary fact that cannot be resolved in a s 81A hearing.
