1Under s 120 of the Tasmanian Civil and Administrative Tribunal Act 2020, the presumption that each party bear their own costs may be displaced where a Calderbank offer was unreasonably rejected and the complainant's case had little merit, with deficiencies that should have been apparent before the offer was made.
2A Calderbank offer open for only two days may be reasonable where the offer is relatively simple, generous, and explains the deficiencies in the offeree's case, and the offeree does not suggest the short period prevented proper consideration.
3Financial imbalance between the parties is not, of itself, a relevant factor in the costs discretion in anti-discrimination proceedings.
