The Court held that the first respondent was overwhelmingly the successful party, and that the issue on which the appellants succeeded (amendment to consequential survey orders) was ancillary, not clearly dominant or separable, and occupied comparatively minimal preparation and hearing time, insufficient to justify departure from the usual costs rule.
