The Tribunal ordered the council to pay the respondent's costs on the Supreme Court Scale incurred from 29 March 2024 in defending an enforcement application that was ultimately refused, finding it was fair to do so because the council proceeded to a hearing despite having received detailed grounds of defence six months earlier that exposed fundamental evidentiary deficiencies in its case, but declined to award costs for earlier tranches of the five-year proceeding.
