The Tribunal declared that the landlord's purported forfeiture of a motel lease was ineffectual and unlawful because none of the three alleged breaches relied upon in the breach notice — refusal of access to inspect, unauthorised remedial work, and failure to clean gutters and gardens — were established as subsisting breaches of the lease, and ordered the landlord to restore the tenant to possession.
