The Tribunal held that where the only permit trigger for a single dwelling was the Design and Development Overlay, dwelling density was not a relevant consideration, and facilitative policy language encouraging four-storey apartment development could not be construed to discourage or preclude a two-storey single dwelling that met the overlay's built form requirements.
