The Tribunal refused the applicant's application for a declaration that a planning permit for use and development of land for an office had expired, holding that the commencement of development for the purpose of an office constituted commencement of use for that purpose under the inclusive definition of 'use' in s 3 of the Planning and Environment Act 1987 (Vic), and accordingly the use had commenced within the two-year period specified in the permit.
