The guarantor's defences — that her signature on the guarantee was forged, that the debt was inaccurately calculated, and that the plaintiff was estopped by settlement representations from pursuing the claim — all failed for want of evidence, the guarantor having not appeared at trial. The Court confirmed that a prior deed of settlement was confined to an earlier proceeding and did not release the guarantor from liability for the invoices sued upon in this action.
