The Court dismissed a self-represented prisoner's application for disclosure of critical documents under s 26 of the Civil Procedure Act 2010 (Vic) in judicial review proceedings challenging conditions of confinement. The Court held that the failure to identify with precision the decision(s) sought to be reviewed made it difficult to determine what documents were critical to the resolution of the dispute, and that the defendants had already provided or undertaken to provide the documents that were critical at this stage of the proceeding. The Court left open that further disclosure may be required as the proceeding progresses and dispositive issues become more clearly defined.
