The Judicial Registrar ordered uplift and inspection of documents produced under subpoenas, holding that the plaintiff had established a legitimate forensic purpose (identifying the defendant's suppliers to quantify its claim) and that the defendant failed to meet the stringent standard required to support redactions for confidentiality. The defendant did not sufficiently particularise the basis for each redaction, did not demonstrate that the information was in fact confidential, and did not articulate with adequate specificity how disclosure would cause real risk of significant harm. For bank statement subpoenas, inspection in unredacted form was limited to the plaintiff's counsel and solicitors under a confidentiality regime. The court left unresolved whether the parties were 'trade rivals' within the Mobil Oil exception.
