A VCAT member conducting a telephone hearing in the Residential Tenancies List must take positive steps to inform a self-represented litigant of their right to request that witnesses be called for cross-examination, and must give reasonable opportunity for documentary evidence to be put before the Tribunal even where it was not filed in compliance with directions, particularly where the evidence is already in the possession of the opposing party at the hearing.
