Where a deed of settlement is executed in counterparts by exchange between solicitors and the defaulting party's solicitors subsequently confirm the intention to perform, technical objections to the mode of execution raised only after default will not defeat an application for judgment, particularly where s 41(4) of the Law of Property Act 1936 (SA) applies.
