The fact that the custodial portion of a sentence will be fully served before an appeal is heard does not, of itself, establish exceptional circumstances where the offending involves serious family violence, a pattern of similar offending, multiple active intervention orders, and the applicant demonstrates limited insight and inability to control behaviour.
