The Court held that a Judicial Registrar's determination under Part 3 of the Courts (Case Transfer) Act 1991 not to transfer a Magistrates' Court proceeding to the Supreme Court is the exercise of a judicial function, not an administrative one, and therefore cannot be judicially reviewed by a judge of the Supreme Court. The determination was characterised as judicial because it involved a procedural order made in a controversy between parties, required the formation of an opinion on statutory preconditions after considering submissions, and produced a binding determination affecting the parties' rights. The Court left open whether judicial review remedies might be available against a Magistrate's determination under the same Act, and did not determine whether an appeal under Order 84.05 of the Rules was available as that avenue had not been pursued.
