A party seeking production of a costs agreement in the Costs Court on the basis of a potential breach of the indemnity principle must articulate the legitimate forensic purpose before the Costs Registrar and establish on the material that it is likely the indemnity principle has been displaced; a bare discrepancy between invoiced amounts and the bill of costs at a point in time before taxation is completed is insufficient.
