The Court held that a manager appointed under s 336 of the Legal Profession Uniform Law has power to require a former practitioner to provide login credentials to an email account used in the conduct of the law practice, even where the account also contains personal communications, and that the manager may delegate administrative tasks to employees without breaching the confidentiality obligation in s 362, provided appropriate safeguards (such as undertakings to the Court) are in place. The Court found civil contempt proved beyond reasonable doubt where the practitioner's claimed 'honest misunderstanding' of plainly worded court orders was rejected as a calculated refusal to comply, and refused a stay of the orders on the basis that none of the three proposed grounds of appeal was arguable.
