The right to be 'in the open air' under s 47(1)(a) of the Corrections Act 1986 (Vic) requires an evaluative assessment of whether a space permits access to sun, rain, wind and other weather, provides a sense of being exposed to the outdoors, and is of sufficient size to permit meaningful movement; small, heavily covered rear cell yards attached to management unit cells are unlikely to satisfy this requirement.
