Pleading a prior Deed of Release as a complete bar to a current institutional abuse proceeding does not, without more, amount to implied waiver of client legal privilege over documents relating to the prior settlement; the broad scope of the 'just and reasonable' test in DZY does not alter orthodox principles of implied waiver under s 122(2) of the Evidence Act 2008 (Vic).
