Where an application for judicial advice by an estate administrator is in substance a vehicle for resolving adversarial disputes between potential beneficiaries about occupation of estate property, the usual costs-follow-the-event rule applies and the unsuccessful beneficiary may be ordered to pay costs on an indemnity basis where claims were maintained without reasonable foundation.
