Where a trial and subsequent appeal leave questions of ownership of trust property unresolved because claims were not proved on the balance of probabilities, court-appointed trustees may make their own good faith determination as to ownership and seek judicial advice confirming they are justified in that determination, without being bound by the burden of proof framework that applied at trial.
