A contingency uplift applied as a matter of client budget management is not an appropriate basis for uplifting an estimate of recoverable party/party costs for security for costs purposes, and a counterclaim that is wholly defensive (seeking only to set aside the agreement sued upon) should not attract a significant counterclaim discount.
