Practitioners drafting or advising on back-to-back subcontracts in PPP projects must understand that linked dispute suspension clauses survive the downstream party's withdrawal of its linked claim — a subcontractor cannot unilaterally de-couple the back-to-back dispute resolution regime by withdrawing its positive claims while maintaining defensive positions on the same factual substratum. The SOP Act ss 13 and 48 will not be applied to void such clauses in the abstract absent a live payment claim.
