Workers who receive statutory compensation under an interstate workers' compensation scheme are not caught by the serious injury gateway in s 326 of the WIRC Act when pursuing common law damages claims in Victoria against non-employer defendants. Practitioners acting for defendants in such cross-jurisdictional claims cannot rely on the plaintiff's receipt of interstate compensation to require compliance with the serious injury certification process under ss 326-327 of the WIRC Act.
