The Court of Appeal held that sentences of 18 months for aggravated burglary and 2 years for theft arising from a staged armed robbery were manifestly inadequate, even accounting for the respondent's mitigating circumstances including mental health diagnoses, good rehabilitation prospects, and the fact that no one was physically harmed. The Court resentenced the respondent to 24 months for aggravated burglary and 3 years 3 months for theft, resulting in a total effective sentence of 4 years 1 month with a non-parole period of 2 years 3 months. The Court confirmed that in staged armed robbery cases, the insider's breach of employer trust is a significant aggravating factor, and that the staged nature of the robbery reduces the seriousness of the aggravated burglary charge only to a limited extent, while not diminishing the seriousness of the theft.
