1A sentence of 9 months' imprisonment for shoplifting offences of low objective gravity may fall within the permissible range where the offender has an extensive and relevant criminal history, a high risk of reoffending, poor rehabilitation prospects, and non-custodial dispositions have repeatedly failed.
2Fresh evidence of deterioration in a prisoner's mental health and self-harm in custody will not be admitted on appeal where the risk of such deterioration was squarely before the sentencing judge and taken into account; complaints about the effect of imprisonment are generally matters for the executive, not the courts.
3Where a court's formal record of orders is inconsistent with the sentence orally pronounced, s 104A(5A) of the Sentencing Act 1991 permits the appellate court to correct the record to reflect the sentence actually imposed.
