A breach of a statutory precondition in the exercise of a power to dismiss a police officer does not necessarily render the dismissal 'unjust' within the meaning of s 152(2) of the Victoria Police Act 2013; the question requires an evaluative judgment having regard to all the circumstances, and a DIO authorised to inquire into and determine a charge has power under reg 52 to amend that charge.
