An intermediate appellate court may grant injunctive relief to preserve the subject matter of litigation pending a special leave application to the High Court, applying the Burgundy Royale test, and may dispense with the usual undertaking as to damages where the applicant is impecunious, the proceeding is a group proceeding involving public housing residents, and the issues raised are of public importance.
